This website and online store are operated by Brito Merchant Group LLC under the Kalaveras Merch name. Throughout these Terms, “Kalaveras Merch,” “we,” “us,” and “our” refer to Brito Merchant Group LLC. By visiting shop.kalaveras.com, creating an account, or purchasing from us, you agree to these Terms of Service and the policies referenced below.

1. Online store terms

You must be at least the age of majority in your state or province of residence, or have permission from a parent or legal guardian, to use this store. You may not use our products or services for any unlawful or unauthorized purpose.

2. Products and availability

We make reasonable efforts to display product colors, images, descriptions, pricing, and availability accurately. Screen settings and manufacturing processes may cause minor differences. Some products are produced on demand through third-party fulfillment partners, including Printify. We may limit quantities, discontinue products, correct errors, or cancel orders when necessary. Limited-edition products may not be restocked.

3. Orders and acceptance

Your order is an offer to purchase. An order confirmation does not guarantee acceptance. We may refuse, limit, or cancel an order for reasons including suspected fraud, pricing or inventory errors, payment issues, or resale activity. If we cancel an order after payment, we will refund the affected amount to the original payment method.

4. Pricing, billing, and payment

Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping charges, and other applicable fees are displayed at checkout. You agree to provide current, complete, and accurate billing, payment, and contact information. By submitting payment information, you represent that you are authorized to use the selected payment method.

5. Shipping and delivery

Shipping and delivery estimates are not guarantees. Stocked merchandise typically ships within 24 hours, excluding weekends and holidays. Print-on-demand products generally require production time before shipment and may arrive separately from stocked items. Risk of loss transfers as permitted by applicable law. Please review our Shipping Policy for current processing estimates, tracking information, and address-change procedures.

6. Returns, refunds, exchanges, and cancellations

Returns, refunds, exchanges, and cancellations are governed by our Return and Refund Policy. Stocked and print-on-demand products may have different eligibility requirements. Nothing in these Terms limits any non-waivable rights available to you under applicable consumer-protection law.

7. Intellectual property

The Kalaveras name, logos, artwork, photographs, product designs, text, graphics, and other store content are owned by or licensed to Kalaveras Merch and are protected by intellectual-property laws. You may use the site only for personal, non-commercial shopping. You may not copy, reproduce, distribute, modify, sell, or exploit our content without prior written permission.

8. Reviews, feedback, and submissions

If you submit reviews, photographs, ideas, feedback, or other content, you confirm that you have the right to share it and that it does not violate any law or third-party right. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with our business and marketing. We may remove submissions at our discretion.

9. Prohibited uses

You may not use the site to violate laws; infringe intellectual-property rights; submit false or misleading information; transmit malicious code; collect personal information without authorization; interfere with security; scrape or access the store through unauthorized automated means; or engage in fraudulent, abusive, or harmful conduct. We may suspend or terminate access for prohibited activity.

10. Third-party services and links

Our store is hosted by Shopify and may use services provided by payment processors, Printify, shipping carriers, analytics providers, and other third parties. Third-party services and websites are governed by their own terms and policies. We are not responsible for third-party content or services except as required by law.

11. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the store, you acknowledge that information may be processed by Shopify and other service providers needed to operate the store, fulfill orders, process payments, prevent fraud, and provide customer support.

12. Disclaimer of warranties

To the fullest extent permitted by law, the site and services are provided “as is” and “as available.” We do not guarantee that access will always be uninterrupted, timely, secure, or error-free. Products remain subject to any express warranties stated on the product page and to rights that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, Kalaveras Merch and its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the site or purchase of products. Where liability cannot be excluded, it will be limited to the maximum extent permitted by law. This section does not limit liability that cannot legally be limited.

14. Indemnification

You agree to indemnify and hold harmless Kalaveras Merch and its affiliates, personnel, and service providers from third-party claims arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person’s rights, to the extent permitted by law.

15. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of that provision or any other right.

16. Governing law

These Terms are governed by the laws of the State of Nevada and applicable federal law, without regard to conflict-of-law principles. Mandatory consumer protections and venue rights that apply in your place of residence remain unaffected.

17. Changes to these Terms

We may update these Terms by posting a revised version on this page. Material changes will take effect as required by applicable law. Your continued use of the store after an updated effective date constitutes acceptance of the revised Terms.
